Lets start with this. I could care less what CC said, the facts are that the law must be followed. This is the new law, it will be followed!

- "Application for development" means the application form and all accompanying documents required for approval of a subdivision plat, 28site plan, planned development, conditional use, zoning variance, or 29direction of the issuance of a permit pursuant to the "Municipal Land 30Use Law," P.L.1975, c.291 (C.40:55D-1 et seq.) or R.S.40:27-1 et 31seq., for any use, development , or construction; 32 1 1


"Impervious surface" means any structure, surface, or improvement that reduces or prevents absorption of stormwater into land, and 11includes porous paving, paver blocks, gravel, crushed stone, decks, 12patios, elevated structures, and other similar structures, surfaces, or 13improvements; 14


 


"Major Highlands development" means , except as otherwise 1 1 1provided pursuant to subsection a. of section 29 of this act, (1) any 24 1non-residential development [, whether or not it also qualifies as a 25 1development as defined in the "Municipal Land Use Law," P.L.1975, 26c.291 (C.40:55D-1 et seq.); any residential development, whether or 27not it also qualifies as a development as defined in the "Municipal 28Land Use Law," P.L.1975, c.291 (C.40:55D-1 et seq.), that provides 29for the ultimate disturbance of one acre or more of land or an increase 30in impervious surface of one-quarter acre or more; or any residential 31development, whether or not it also qualifies as a development as 32defined in the "Municipal Land Use Law," P.L.1975, 33


"Waters of the Highlands" means all springs, streams including 1intermittent streams , and bodies of surface or ground water, whether 22 1natural or artificial, located wholly or partially within the boundaries 23of the Highlands Region , but shall not mean swimming pools . 24 1 1


This is very interesting.  So how do you all think the planning board will deal with this?

Hey Kim,


Do you recall if there were any springs noted on the map of Agilent?  I know there are streams and well fields.  I think there may be some springs as well.
