Another good Cindy article in todays NN regarding the proposal for a QuikCheck and Gas Station where Benny's used to be. Seems the town is asking for a letter of interpretation from the DEP to confirm the C1 status of Hibernia Brook. As such it would require a 300' buffer and probably prevent the proposed project even being outside the protected Highlands zone. Also required is classification restrictions for building so close to twp. wells. Who knows, the all mighty may be stuck yet with only offices to show for his $10.25M.
My understanding is that the 300 foot buffer requirement is only for those projects which are new, or if they are existing, they cannot expand impervious coverage to an amount more than 125% of the existing impervious coverage. As such, this rule would apply to the new quick check/gas station project but not to cc if they are within the 125% standard. Is my understanding incorrect?
I'm not sure anymore. Maybe someone else is. Guess it would then boil down to whether the complete razing of the main bldg qualifies as "new" or existing. Regardless, I still think it means that there is a long way to go before we ever see a Mega Liarland.
I like your interpretation and hope you're correct. Common sense would also dictate that when you take the existing footprint and make it significantly deeper, that also counts for something.
