First how do you know the board will not approve it. And in court things can move fast or slow The town would not appeal if it lost in court because to much cost to the tax payer.
Not to mention agilent could sue the town and the justice dept could make a charge that the churches rights have been hit. I have heard that from some lawyers not sure how that would work but I think the town should look into it before they go that way.
Many cases get settled when this happens pretty fast. I even heard the mayor say in the paper months ago courts in NJ favor churches in this.
Lets just try to do whatever is legal who ever wants to buy the land church,temple,company that is all the people in town want.
