Letter Sent to Township Council


The following letter has been sent to the Rockaway Township Council via email and certified mail:

Dear Michael Dachisen & Council Members,


A New Township ordinance is needed. It should preclude the congregation of children for any reason whatsoever on brownfields (polluted properties) until they are properly cleaned up first.

Do you understand the wisdom of this proposal? Let me amplify.

Now that the idea of a township ordinance precluding the congregation of children on polluted property has been proffered and documented by a citizen (myself), there exists a legal liability if the township does not act on it. I will follow-up with a posting in the Star Ledger shortly in the legal notices section to establish a legal record of this proposal.

Now, imagine (G-d forbid) ten years from now that a cancer cluster of people emerges who had been children congregating weekly or more on a known polluted property in the township.

Now, imagine the legal culpability of two entities for not taking the proper steps to assure children's safety. The responsibility would fall onto two legal entities:

1. The entity holding the congregation of children on such a property.

2. The Township in which the property is located for not paying heed to the recommendation that you have seen presented here (this would come out in the discovery process in the event of a class action lawsuit in the future).

Bottom line - - - Mayor Sceusi and Rockaway Township councilmen please take note - - -

It is at great peril to children and at great risk to the taxpayers of this township if you do not pass the mentioned ordinance precluding the congregation of children on brownlands or polluted properties that have not been properly cleaned up. The relationship between toxic chemical exposure by children during their developing years is well documented in the scientific community and can not be ignored.

Consider yourselves to have been forewarned of the outlined risks.
