Why do we not consider just condemming the land for other reasons. Here is a good one for starters. The town well is located on that property. It serves the people who reside in White Meadow, etc. It's aquafer is fed by the runoff from the Agilent property and the two streams which confluence at that property.
It would seem to me that disturbing any of the chemical polutants located there will place the people who use that well in serious potential peril. I would suggest that we condem the land for the protection of those people and just let the land grow back to natural forest to protect our towns water resources.
Are there any land use lawyers who want to comment on my idea? Any citizens of RT?
Interesting idea. I assume the price the town would pay for the property would be it's fair value. The question is that if the property is currently not marketable because it needs remediation, is that fair value equal to the expected selling price assuming no environmental problems less the expected cost of remediation. Is so, the price to condemn may not be very costly for the town.
Does anyone have any expertise or knowledge in this area?
