Best Compromise

The town gets:

The entire site via an eminent domain. This allows for a wonderful school with room for expansion as the town grows.

The megachurch gets:

To show that it really is a charitable organization by building its new megastructure where there is truly the infrastructure to support it.

Sounds like a win-win.

Anything less than this allows the megachurch to seek to expand at a future time when the town no longer has the resources (ie agilent tax revenues) to fund the legal costs.

An Offer

It is a great compromise, but only after we sue your butts off so that we can purchase property elsewhere.  I would say that 50 to 100 million will do the trick.  Do you want to pay us now or wait until later?  50 now, 100 if you wait.  Remember, we will go for triple damages since this is a civil rights violation.  That we are taking to the bank.

Pish tosh. Via RLUIPA you'd get attorneys' fees and court costs IF you win.

It's a simple land deal between the township and agilent after the contract with cc expires.  What's wrong with that?

It's better than postponing the problem until later.

School problems

The BOE early report does not bode well for the construction of a new school. As a matter of fact, it may prove to costly even for Irelands deep pockets. There is much environmental remediation that will be nedded before anyone gets a permit to construct anything. I believe it is probably to much to take on as a new school site. Too bad, as this location is the best choice.

It seems to me that the entity that made the polution will be held responsible for its cleanup irregardless of who purchases it or takes it by condemnation.  That party is Agilent.  So, I do not think it is a practical problem

The point

The point being made is this - the school that RT needs will not be able to wait all the years that this thing is going to drag on for. I t will cost BIG BUCKS to clean this thing up. CC could never build a school (as well as RT) on this site until State and Feds are satisfied. Agilent is certainly responsible for the cleanup that will need to be done, this alone will take many years. I believe CC will choose to move on when the scope of the problems are revealed with the site.

Does anyone know if the Agilent site is classified as a "superfund site"?

I do not believe this site has been officialy added yet - it is to soon to guess as to the extent of the pollution. I will guarentee that there will be some in-depth studies to follow though.
