Thank you for submitting comments to the Department on the Christ Church Highlands Applicability Determination. We have received several requests from you requesting a public hearing on this exemption determination. Please be advised that the Highlands Rules (N.J.A.C. 7:38) do not provide for a public hearing on Highlands Applicability Deteminations. As a result the Department cannot honor your request for a public hearing on this application.
The Department requests that all comments and information that you have concerning this application be forwarded to the Department in writing. As you are aware the public comment period on this application was published in the November 2, 2005 DEP Bulletin and the official comment period closed on December 2, 2005. However, the Department will consider any comments received prior to rendering a final decision. As you know, discrepancies in the impervious surface calculations have resulted in a technical deficiency letter being sent to the applicant on November 30, 2005. Therefore, no decision on the application is possible until these discrepancies are resolved. Depending on the significance of the change in the application, the Department may elect to reopen the comment period on this application once the applicant responds to the letter. A significant change will be one in which the plan of site development changes, not a simple correction of a calculation. In the event that the changes to the application are not significant, I urge you to submit any additional comments to the Department as soon as possible.
Please be assured that the Department will prepare a comment and response document addressing all timely comments received on this application and that document will be issued simultaneously with a decision on the application.

The Christ Church Plan for the redevelopment of 140 Green Pond Rd is just too big for the area.
