As far as my prediction on the DEP. I think its a 50/50 chance at this point. The question is whether there will be any damages for the false information in the first plan. If they discount that and go directly to the new plan, CC wins. No self-serving BR-Drama here, just stating the obvious.

It was the ONLY realistic solution to the problem, but now its time has past. Shame on all of you for not hiring your own personal land use lawyer to discover the real nature of the problem and its only solution. I got two paid for legal opinions on this issue and rendered those opinions here on this board. My only genius was my personal hiring of the legal experts to find out the probability of keeping cc out of here.

Churches Worry Tax-Exempt Status Puts Them At Risk
A number of churches are concerned their tax-exempt status will put them at risk of losing their property through eminent domain procedures under the recent Supreme Court ruling. Christianity Today quoted Derek Gaubatz, director of litigation for the Becket Fund for Religious Liberty, as saying, "It is not an idle concern" and that churches "'will be in the crosshairs' of local governments seeking more tax revenue." The article cites the experience of Living Faith Christian Center, which in 2002 purchased 28 acres for $6 million, then nearly had to sell the land when Camden County and Pennsauken Township protested.
The New London Connecticut Supreme Court ruling established that municipalities can condem land to optimize tax revenues on same. Clearly, the overtaking of the 140 GPR property by Conspicious Consumption Business has minimized RT's tax revenue on same.
So, why don't you guys just take the land? It is your only option if you want to preserve the taxes (and basic character) of your township.
Otherwise, you are looking at a 99% probability that cc will build their Gigachurch. RT will become quite infamous (actually, it already is infamous because of this $hit).

Sorry Rat, I didn’t realize this forum was a competition on who could guess the outcome of this dilemma. If you look at the rest of my "brainless and spineless" response, instead of pulling out one sentence, you will realize that I am spot-on in my "asinine" analysis (just ask anyone on the planning board, the mayor or council as I did)
So let me clarify what I said again: The question is whether there will be any damages imposed from the DEP for the false information in the first plan. If they discount that and go directly to the new plan, CC could win. CC has to overcome 2 hurdles: First is the DEP, second is they need to overturn the new Ordinance. This they know. I would say more, but do not want to "show RTs hand" on this forum.
You are a smart man Craig. A pain in @ss, but smart non-the-less. Your problem is that you draw a conclusion based on your paranoid belief that the Christian-Right-Wing controlled judicial system will weigh in CCs favor and discount the rights of 23,000 tax paying residents.
You want a prediction?, here you go buddy, I'll throw you a bone. My prediction is the courts will decide the outcome and it will not be for another 2-3 years or more. In that time CC will impose many more law-suites and negative PR campaigns against the township. I also believe that Ireland stands a chance of losing his following during this time, as his flock will realize his plan to take their money and abandon them by moving his country club 30 miles away to attract new members with a higher net worth.
Today I am feeling optimistic; I give it a 55-45 in favor of the township.
That expression of opinion was more succint than those in the past. Good. One thing that I will agree with is that the courts will decide this thing, not the planning board.
As for the DEP, the new plans are designed to pass Muster and so will. As for punishment for incorrect information provided previously by ire-land, he will get a little slap on the wrist. Done.
In terms of my paranoia about the Christian Right and its influence on the courts. you are correct. I believe that the tides are turning in favour of the extreme right wing thinking in the US. The pendulum swings and that is the way it is going. Clearly, that reduces the chances of a favorable ruling for RT.
