August 31, 2005 - Court renders decision on CC DEP exemption....
The courts have remanded the case back to the DEP finding that the DEP did not have ample information to render a finding. The court stated that the state and Rockaway Twp agree that the exemption is not valid. The court also found that Christ Churches counter claim had no merit and strongly worded that CC had no grounds to state that the exemption was granted with full information.
The DEP will have to evaluate the application again under an open format allowing the public, environmental organizations and the town to comment.
Effective Aug. 31, 2005 CC no longer has an exemption from the Highland and may not ever have the exemption again. Effective Aug. 31 their plans MUST comply with all the provisions of the Highland Act.
The future of the planning board meetings are uncertain at this point.
