Tomorrows paper


I received a call from Rob Jennings today - and here is tomorrows headline... CC is not planning on filing a law suit...as of now.  I have no idea why this is "news" but it appears that they find this 'non-news' some how to be "news"

Well, that fact really sucks!  You all know what that means; he will be using the "get his foot in the door" methodology.  It is gonna be some really heavy sledding for RT now.


Are you sure that you folks do not want to


Condemn the Property Now Before It Is too Late?


 


BTW - It looks like I got another prediction right here.  It sure would b e nice to be wrong regarding this issue, at least once! Too bad others do not see the implications of our own response to this clown and his circus.

There are battles and there are wars - do not be short sighted.  I would suggest you look a little further at some recent court opinions about condeming property - the law is not on our side in a case like this.  If you want CC to move in next week then condemn now - if you seek to have a project/owner on that property that is the appropriate size for the area then our town team is heading down the right road.


If you have not noticed - so far Rockaway Twp is winning.  The project is much smaller then the original plan and is likely to get smaller...in the small chance it ever gets approval at all.  While I share you concern about the "foot in the door' attitude and hope that never happens - taking careful steps at this time is what is important.


The fact that CC is not planning to sue at this time shows they know darn well they have NO case and that RT has done NOTHING wrong.  If they thought they had RT on a technical issue you know they would march off to court faster then you can say "RLUIPA".


Hey Whiney - All those big words over the last few weeks about filing a law suit were nothing but PR BS!  You are such a joke!  How can you take money from the good memebers of CC and sleep at night - have you no ethics???

Foot in the door


Question about the 'foot in the door' theory:


Zoning is one thing - but the Highlands Law clearly states that that property can NOT be expanded.  Christ Church CLEARLY knows about this law moving in.  I do not see how they could move into a property with KNOWN environmental conditions (not added later , but stipulated before purchase) and still attempt to bypass these regulations.

The law clearly states that an exempt house of worship had to exist before the law was signed...how will he skirt that fact?

I'd like to mention two things:

1. They didn't say they won't sue.

According to the headline, they're "not set on court fight".

They "haven't decided whether to file a lawsuit..."

They say "Litigation is a possible remedy, but it is not the only remedy."

There's nothing in that article that says they WON'T sue.


2. This entire exercise appears to me to be an effort to make the opposers of the plan look foolish, and try to recruit supporters.

"See, we're nice guys! Those suspicious opposers are so silly to think we would ever sue Rockaway Township. What a crazy idea!"

headlines like this could usher in a NEW breed of journalistic integrity.  Just think what next week's headlines might be:

Who knows what they are thinking. All we can be sure of is that its probably not in the best interest of RT. Apparently the DR didnt think it was major news either. I cant locate any online link to use on the website. I think Rob just wanted to remind people about the story again before next Mondays meeting, which isnt a bad thing to do. Ya never know, Whiney and company may parade in a gaggle of attorneys next Monday and threaten everyone again.

Maybe I am blind or stupid or something, but I really had not noticed that.  He is exempted from the Highlands legislation. If he got in here with a 100 person church, that would be the catalist to get the thing moving big time.  And I am pretty sure that the "system" would do nothing politically incorrect (ergo politically dangerous) to stop this guy from doing whatever he pleases.


We shall see - - - but eminent domain is awful hard to fight in court not matter who you are!  Ask a lawyer; then you will know.
