From the nj.con board

I wonder what this is about:

3492. NEWS FLASH!
by rtfirefriend, 12/23/04 16:14 ET
You must get to townhall next week! There is information in the reports submitted by CC that clearly indicated that they KNOW that they are not entitled to the exemption issued by the DEP.

This is going to be a very merry christmas indeed!

John,

Isn't the abovementioned statement just semantics?  What I mean is that "they know that they are not entitled an exemption" is completely irrelevent, right?  Of course, everyone knows that the law was set up to protect watershed properties like Agilent.  But, as everyone knows, the political power intrinsic in a Minority owned church clearly outweighs any envorinmental issues in the political arena.

A politically motivated decision was made.  The fact of the matter is that they DID get an exemption, whether they deserved one or not.  And that is all that counts.  And nobody can hold CC 's feet to the fire for the fact that they may have known that they did not deserve what they got based on environmental law.  Political reality is just that - - - reality.

what about the null and void part? Interesting...

3492.1.1. in short

there is a line in one report that states they know the plan is larger then that which was submitted to the DEP. This is clearly spelled out. It is also clear in the DEP EXEMPTION that if there are any changes the exemption is null and void.

My take on that one is quite simple.  If their plan becomes larger than that which was submitted to the DEP, it could nullify the existing exemption.  But, all that means is that they will apply for another exemption.

Guess what??  The WILL get it!

Daniel (Craig),

I wouldn't be so certain about that...The first DEP exemption was issued before the Highland's commission was formed.  There was also a backlash for HOW the decision was reached - without any comment from the town.

IF (big if) this goes back to the DEP, it will most likely go to the commission, and I imagine our town has learned their lesson and will be alert enough to make sure their VOICE IS HEARD.

Jay,

I would like to say that I wish that you are correct, but the world that I have been living in just does not work that way.  I wish that it worked your way, but it just does not.  Sad, but true.

Daniel,

You're too young to by cynical like me or that crotchity old guy you live with ()...Firefriend has been right - since cc has been forced to scale back, they have switched to a VERY defensive mode.  I doubt that you were at the planning board meeting - I know your uncle wasn't because I didn't see him.  cc is clearly on the defensive - trying to manipulate their plan AND get what they need as far as space goes...Think about it - it's been almost 3 months since their "shrinking the plan to help the town <to borrow a phrase from some of our nj.con friends>" and they STILL do not have a comlete architectural plan and they're architect didn't want to commit to one for the next meeting (Ms. Berger was pretty much forced to say he'd have it)....

Someone on the other site had a comment about not being able to fit 10 pounds of balony into a 5 pound container....well...they've got 400 pounds to fit in an ever shrinking container....as firefriend said - more holes than swiss cheese.

Jay,

Well, I certainly do not want to become cynical or crotchity well before my time!  So, I will pray for the best to happen for the citizens of RT - - - who knows, maybe this whole nightmare situation will collapse in on itself under its weight, so to speak. Let's hope so.

The only problem for you is if cc DOESN'T win, your uncle Craig might not sell out to you - he might realize he lives in a beautiful location (I'm a bit down the road from him).
